By purchase and/or use of this permit, I agree to the following terms and conditions: As a condition of being permitted to use this property for hiking, skiing, mountain recreation and equipment, I hereby agree to accept all of the rules and regulations of this property for hiking, skiing and mountain recreation.  I further agree to release, indemnify and hold harmless this property for hiking, skiing and mountain recreation, the Mount Washington Cog Railway, and each of their respective owners, affiliates, subsidiaries, officers, directors, successors, employees and agents (hereinafter collectively referred to as “RELEASEES”) from any and all liability for damages due to personal injury, death, and property damage which results in any way from the risks inherent in the sport of hiking, skiing, snowboarding and any other related activities (Hereinafter collectively referred to as “ACTIVITY”) at this property for hiking, skiing and mountain recreation. I understand these inherent risks include, but not limited to, any and all variations in weather, terrain, surface or subsurface ice conditions, bare spots, moguls, elements, ruts, bumps, rocks, trees, forest growth, pole lines, fences, snowmaking equipment, railroading equipment, and collisions with other hikers, skiers/snowboarders or other persons or objects within any category of this release. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY WAIVE, RELEASE, INDEMNIFY, AND HOLD HARMLESS each of the RELEASEES, from any and all claims, demands, costs, expenses, losses, or liability arising out of or related to any property damage, INJURY, DISABILITY OR DEATH  or loss of any kind that I may suffer (the “Losses”), WHETHER ARISING FROM THE ACTIONS OR INACTIONS (INCLUDING NEGLIGENT ACTIONS OR INACTIONS) OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. In regard, the permit holder hereby agrees to hold RELEASEES harmless and indemnify and defend same against any and all claims, liabilities, damages, liens, and expenses, (including, without limitation, reasonable attorney’s fees) arising directly or indirectly from any such occurrences.

Further, permission is hereby given to use any photographs or video of myself or my child taken during their participation in the ACTIVITY for any purpose in promoting RELEASEES. 

I further agree that any claim I may bring at any time for any reason against RELEASEES shall be submitted to the jurisdiction of the State or Federal Court of New Hampshire and none other shall be governed by the laws of New Hampshire. If any part of this agreement is determined to be unenforceable the remaining portions shall remain in full force and effect.
